How to Start a Therapy Practice in Florida

Starting your own therapy practice in the Sunshine State can be both rewarding and challenging. Whether you’re a licensed therapist or just embarking on your counseling career, here are the essential steps to get your practice up and running

1. Check Local Zoning Regulations

Florida is a diverse state with 67 counties and 411 municipalities. Before you settle on a location for your therapy practice—even if it’s your own home—take a moment to explore local zoning laws. Here’s what you need to know:

  • Zoning Variance: Sometimes,  your desired location doesn’t typically allow for business operations. For     instance, operating a home-based therapy practice in a residential area     might require a zoning variance—an exception to the usual rules. Research  your local zoning regulations and consider applying for a variance if     needed.

2. Register a Fictitious Business Name (DBA)

If your therapy practice operates as a sole proprietorship or general partnership, you’ll need to register a fictitious business name (also known as a “doing business as” or DBA name). Follow these steps:

  1. Search Florida’s Fictitious Name Records: Make sure your desired business name isn’t already in use. You     don’t want any naming conflicts down the road.
  2. Advertise Your Name: While proof of advertisement isn’t required, you’ll personally certify that your chosen name has been advertised. Place an ad in a local newspaper to announce  your new business identity.
  3. Register Online: Visit SunBiz.org, Florida’s official business registration portal. Follow the prompts to register your  fictitious name. There’s a $50 filing fee.

3. Choose Your Business Structure

Selecting the right business structure is crucial. Florida recognizes several options:

  • Sole Proprietorship: Simplest form, where you’re the sole owner.
  • General Partnership: Shared ownership with partners.
  • Business Corporation: A separate legal entity.
  • Professional Service Corporation (PC): Specifically for licensed professionals.
  • Limited Liability Company (LLC): Offers liability protection.

Consult with a business attorney or accountant to determine the best fit for your practice.

4. Register Your Therapy Practice

File the necessary paperwork with the Florida Department of State to officially establish your business. If you plan to hire employees or operate as an LLC or corporation, obtain an Employer Identification Number (EIN) from the IRS.

5. Obtain Relevant Licenses and Permits

Depending on your practice type and location, you may need additional licenses or permits. Common ones include:

  • Local Business Tax Receipt: Formerly known as an occupational license, this allows you to     operate legally within your locality.
  • Health Department Permits: If your practice involves health services, check if any     specific permits are required.

6. Get Business Insurance

Protect your therapy practice with suitable insurance coverage. Consider the following types:

  • Professional Liability Insurance: Covers claims related to professional services.
  • General Liability Insurance: Protects against accidents or property damage.
  • Business Property Insurance: Safeguards your equipment, furnishings, and office space.

7. Start Paying Taxes

Understand Florida’s tax requirements:

  • Sales Tax: If you sell products (such as books or workbooks), you’ll need to collect and     remit sales tax.
  • Income Tax: Florida doesn’t have a state income tax, but federal income tax still applies.
  • Self-Employment Tax: As a self-employed therapist, you’ll pay Social Security and Medicare taxes.

8. Getting Paid for Your Therapy Services

As a therapist, there are several ways to receive payment from clients:

1. Private Pay(Out-of-Pocket): Clients pay directly for your services without involving insurance. This approach gives you control over your rates and avoids insurance paperwork. Be transparent about fees upfront, and consider offering sliding scale options for affordability.

2. Health Insurance: If you’re in-network with specific insurance providers, you can accept insurance payments. Here’s how it works:

  • Verify client coverage and benefits.
  • Submit claims for reimbursement. Keep in mind that     reimbursement rates can vary, and managing insurance paperwork is part of     the process.

3. Medicare and Medicaid: If you’re eligible, consider becoming a Medicare or Medicaid provider. Follow their billing guidelines and fee schedules. Serving eligible clients within these programs can expand your reach.

4. Employee Assistance Programs (EAPs): EAPs contract with employers to provide counseling services to employees. Joining EAP networks can provide a steady stream of referrals and introduce you to a diverse client base. Be sure to adhere to their guidelines.

5. Sliding Scale Fees: Offer reduced fees based on clients’ income or financial situation. Sliding scale fees make therapy accessible to a wider range of clients and align with your commitment to social impact.

9. Client Intake Process

When a new client reaches out, follow these steps to ensure a smooth intake process:

1. Initial Contact:

  • Respond promptly to inquiries via phone or email.
  • Gather basic information, such as the client’s name and reason for seeking therapy.

2. Assessment and Screening:

  • Conduct an initial assessment to understand the client’s needs and concerns.
  • Screen for any urgent issues, such as safety concerns.

3. Informed Consent:

  • Explain your therapy approach, confidentiality policies, and any relevant details.
  • Obtain written informed consent from the client.

4. Intake Forms:

  • Provide necessary forms, such as an intake questionnaire and privacy practices.
  • Collect relevant background information to inform your treatment approach.

5. Scheduling and Payment:

  • Schedule the first appointment based on availability.
  • Discuss fees, payment methods, and insurance coverage during this conversation.
